Cleveland Cavaliers guard J.R. Smith is currently under investigation by the New York Police for a theft of a fan's cellphone and damaging it afterwards, per TMZ Sports.

The man was supposedly taking a picture of J.R. Smith without his consent and he didn't tolerate it. He snatched the phone from the fan's hand and threw it into the nearby construction zone. The incident was recorded early Sunday morning in Manhattan.

The victim of the incident filed a complaint to the police for $800 worth of damage to the cellphone.

Smith hasn't been charged as of yet, however, he is still waiting to be questioned. It is unknown whether the fan said something or was hassling Smith to make him have an outrage like this. All we don't know for certain, will be heard from Smith's perspective soon.

TMZ Sports has reported a similar situation with Smith earlier in 2015, getting involved in a scuffle with a heckler. This happened after he was traded from the Knicks. However, no further charges or investigation occurred because of the lack of evidence.

Smith started in 61 of his 80 games for the Cavs this season, averaging 8.3 points per game in 28 minutes. He is coming into his 15th season of his career, and now with the departure of LeBron James, Smith has two more years left on his contract and will be proving his worth on this year's new roster involving young star, Collin Sexton.
